In a Stay Request, the Paperwork Is the Argument

The evidence for a stay of removal that ICE requires, what persuades, and the gaps that lead to denials.

ICE decides Form I-246 requests at its discretion, and a denial cannot be appealed. The packet you hand in is usually your only chance to make the case.

THE CONTEXT

Why Is Evidence for a Stay of Removal So Important?

Because ICE can deny the request without a hearing or appeal, the documents must prove every reason for the stay on their own.

Evidence for a stay of removal carries more weight than in most immigration filings. The officer reviewing ICE Form I-246 has no judge to answer to, and a denial “is not appealable.” 8 CFR § 241.6(b)

The same regulation directs ICE to consider the factors in 8 CFR § 212.5 and INA § 241(c). In practice, officers weigh the whole picture: why you need time, what ties you have here, and what risks your record shows.

Required Documents ICE Asks For

These items come directly from the Form I-246 instructions. A packet without them is incomplete before anyone reads your reasons.

Form I-246, completed and signed, one per person; each family member files separately.
Fee of $155, payable to the Department of Homeland Security or Immigration and Customs Enforcement, by cash, money order, or cashier’s check.
Identity: an original passport valid at least six months beyond the stay requested, a passport copy plus a birth certificate, or proof that you applied for a passport.
Written summary of why you are requesting the stay, with supporting evidence.
Medical records, if you claim medical grounds: diagnosis, treatment, prognosis, and the help you need.
Police reports and dispositions for every arrest, and judgment and sentencing documents for any conviction.

Evidence That Helps ICE Say Yes

Strong packets prove each reason with an independent document, not just the applicant’s word.

Reason for the stay
Best evidence
Common weakness
Serious medical need
Signed letter from the treating doctor with diagnosis, treatment plan, and dates
A generic note with no prognosis or schedule
Caregiver of a family member
Birth or marriage certificates plus medical or school records showing dependence
Relationship proof with no evidence of need
Pending path to status
USCIS receipt or approval notices (I-130, I-918, I-360) and case status
A plan to file “soon” with nothing filed
Long ties in the U.S.
Tax returns, employment letters, lease, children’s school records, community letters
Letters that are unsigned or undated
Cooperation with law enforcement
Proof of being a victim or witness in a criminal case
Statements with no agency record

If a family petition is pending, a short timeline showing where it stands helps the officer see what the stay would accomplish.

Translations matter too. Any document in another language should include a complete English translation with the translator’s certification.

Negative Factors You Must Address, Not Hide

ICE runs background checks, so every negative fact will surface. The packet should explain it first.

  • Criminal history: disclose every arrest, attach certified dispositions, and add proof of rehabilitation, such as completed programs or probation records.
  • Prior immigration violations: missed hearings, prior removals, or reentries after removal weigh heavily; explain the circumstances and what has changed.
  • No travel document: show that you applied for a passport, since the form requires it.
  • Inconsistencies: make sure dates and names match prior applications filed with USCIS or the immigration court.

An omitted arrest that ICE finds on its own can sink an otherwise strong request.

A REAL CASE

A Strong Story With a Weak Packet

A mother caring for her U.S. citizen daughter with a congenital heart condition was denied a stay she had filed on her own.

Her packet had a one-line doctor’s note, no passport, and no explanation of an old shoplifting arrest that appeared in her background check.

When she came to me, I requested a detailed letter from the cardiologist with the surgery schedule and recovery plan.

I also obtained the certified dismissal of the arrest, proof of her passport application, and school and therapy records for her daughter.

Because the denial could not be appealed, we filed a new request with the full record. ICE approved a stay through the recovery period.

How to Organize the Packet

1 · Cover letterA one-page summary of the request, the period of stay sought, and an index of exhibits.
2 · Required itemsForm I-246, fee, identity documents, and a copy of the removal order.
3 · DeclarationYour signed statement explaining your reasons, in chronological order.
4 · Tabbed exhibitsMedical, family, immigration, and community evidence, each labeled and listed in the index.
5 · CopiesKeep a full copy of everything filed and the fee receipt.

Expect fingerprints and, often, an interview with an ERO supervisor. Having a lawyer present helps keep the conversation on the evidence.

THE PATH FORWARD

Build the Record Before ICE Calls

Medical letters, certified dispositions, and passports take weeks to obtain. Start gathering them as soon as a final order exists, not after a check-in notice arrives.
